The company TECNOSOFT INFORMATICA & C s.n.c. whose headquarters are at 39 Via T. Claudio, Cles, in the province of TRENTO - ITALY, hereinafter referred to as 'Supplier', owns the domains BOOKYOURRENT.COM and BOOKYOURRENT.IT and is the provider of this online booking service subject to the conditions stated below.
The Supplier provides a booking service to users of the Website BOOKYOURRENT, hereinafter referred to as "Customers", for the rental of sports equipment, hereinafter referred to as the "Rental", through shop network members, hereinafter referred to as "Affiliate Rental Centres", a list of which is also available on the Website. The Supplier receives each Customer Booking on the Website, in the name of, and on behalf of, its Affiliate Rental Centres, without thereby entering into any direct contractual relationship with the Customer.
These General Conditions of Service (hereinafter referred to as "GCS") have been prepared by the Supplier in the name of, and on behalf of, its Affiliate Rental Centres, with the purpose of regulating the contractual relationship between the latter and the Customer.
Confirmation by the Customer of their online booking implies full and complete acceptance of the GCS.
The Supplier reserves the right to modify the GCSs at any time. In the event of any changes, the GCS in force at the time of a booking will be applied to the said booking immediately the Customer confirms their booking in accordance with the procedures described herein.
4-1: Booking Service Through the reservation system, there are 2 different booking services, depending on the type of item or the particular details of the item(s) chosen for rental.
4-1.1: Booking of item category only (Category Rental) In this case, the booking allows the Customer to select a category of equipment without specifying the brand, model or size of the item itself. It is the responsibility of the Affiliate Rental Centre to provide, at the time of the rental, an item belonging to the category booked, adapting it to the Customer's physical and technical requirements.Should the booked equipment category not be available, the Rental Centre will provide the highest quality item available with no additional charge to the Customer.
4-1.2: Rental of specific item (Dedicated Rent) In this case the booking involves the selection of a specific item, identified by brand, model and size. It is understood that the Rental Centre will reserve the item for the dates stipulated in the booking. Changes to the choice of item to to the details of the item may be made at the time of the rental, subject to the descretion of the Rental Centre and alternative equipment being available.
8-1: Item type and size: all changes to category and/or size of a booked item are the sole responsibility of the Affiliate Rental Centre to which the Customer's booking is directed. For all changes of this nature, Customers should contact the Rental Centre directly who will handle the change requested. The Rental Centre will accept the Customer's change request as long as the required product is available in the Centre. Acceptance of such a change by the Rental Centre concerned will have no effect on what was previously paid pursuant to clause 5 of these GSCs. The effect on the Rental Price of the acceptance of such an amendment will be taken into account at the time of the Rental, subject to the conditions set forth in clause 5 of these GSCs.
8-2: On the Internet, an item cannot be added to a booking once it has been made, so should a Customer wish to book an additional item, they need to make another booking for that item, again through the Website.
However, in the event that the Affiliate Rental Centre is unable to provide the Customer with the items booked, the Centre will do everything possible to provide the Customer with equal or superior quality item(s), without prejudice,and should the item(s) be wholly unavailable the Centre undertakes to refund the Customer the total amount paid or the booked item(s). Booked items will be reserved for 24 hours from the start date of the rental. After this deadline, if the items are not collected, they will be reoffered for rental, and any refund to the Customer will be forfeited.
11-1: Right of Cancellation for Item Category Booking (Category Rent) (Clause 4-1.1) The Customer has the right to cancel within 14 days from the date of the booking confirmation, or at least no later than 48 hours before the start of the rental. In line with the terms stated above, the refund will comprise 100% of the total paid, excluding any additional costs (activation and/or administration charges, Free Cancellation options etc.) where relevant.
11-2: Cancellation rights for specific items (Dedicated Rent) (Clause 4-1.2) The Customer has the right to cancel within 14 days of the date of the booking confirmation, or at least no later than 48 hours before the start of the rental. As previously stated, the refund will comprise 100% of the total paid, excluding any additional costs (activation and/or administration charges, Free Cancellation option) if any. The Customer also has the right of cancellation up to 30 days prior to the start of the rental, with a refund of 85% of the total paid, excluding any additional costs (activation and/or administration charges, Free Cancellation etc.) Where present. The remaining 15% will be retained by the Supplier as a collection charge and to cover the service offered. If fewer than 30 days remain prior to the rental date, or if more than 14 days have elapsed since the date of booking, no refund can be made to the Customer.
Collection of the booked item(s), should it occur prior to the stated cancellation date, effectively waives the right of cancellation. Cancellations should be made before the stated deadline by sending an email, with booking voucher attached, to: email@example.com. Upon receipt of the cancellation request, both parties are freed from their respective obligations concerning the booking. A refund will be made by the Supplier, in the name of, and on behalf of, the Affiliate Rental Centre, within 30 days of the date of receipt of the cancellation request.
